Opposition Extensions

On July 1st, 2011, the Trademark Office issued a new Resolution concerning the elimination of the possibility of obtaining an extension to the deadline to file oppositions against new trademark applications. The new resolution is highly ambiguous and leaves many open questions. Risks shouldn’t be taken, we suggest filing any oppositions in due term until the scope of this regulation is clarified by the Trademark Office....

New Patent Annuity Regulations in Ecuador increased maintenance fees and changed the payment deadlines, annuity number and amount to pay. Changes affect granted patents, new and previously filed applications. It is very important to establish the new rules to avoid the abandonment of the patents...

Rolling Stones v. Boca del Pozo

Bermeo successfully represented Musidor B.V., the Dutch agent of the Rolling Stones, in an opposition against Boca del Pozo for an infringing trademark application on the Stones’ famous “Tongue and Lips” trademark.

Telefonica v. Telefonica Ecuaphone

A trademark owner has the right to request to the TM Office to change a company name which was approved by the Companies' Superintendence in violation of its IP rights. In an unprecedented case in Ecuador, TELEFONICA from Spain, represented by Bermeo & Bermeo, brought suit against TELEFONICA ECUAPHONE to have its name changed. On the risk of being being terminated, the company had to amended its charter of incorporation and is now called Ecuaphone S.A. since May 19, 2010.
